The rules around vacation rentals in Hawaiʻi are changing faster than most travelers realize. Maui County is phasing out short-term rentals in apartment-zoned areas over a multiyear timeline. On Hawaiʻi Island, the County’s registration requirement took effect September 1, 2026, and the online registration system is now live.

September is the first useful checkpoint for a late-fall or holiday rental on the Big Island. Existing rentals with valid County permits before September 1 are being carried into the new system, while new operators must register through the online portal. That distinction matters: a host may have a valid prior permit without yet showing a newly issued registration number.

Before paying a deposit, verify the property’s state tax registration and county authorization. A listing on a major booking platform is not, by itself, proof that the rental is legal. Here’s what is changing and where to check.

Maui Mayor Richard Bissen signed Bill 9 into law on December 15, 2025. The law phases out transient vacation rentals operating under the Minatoya exemption in apartment-zoned districts. Maui County says 6,208 Minatoya-listed units were actively operating as short-term rentals as of May 29, 2024.

The phase-out does not eliminate every vacation rental in Maui County. The County says approximately 6,500 TVR parcels will remain, along with hotels, timeshares, and bed-and-breakfast operations. About 60% of the affected Minatoya units are in South Maui and 36% are in West Maui.

A county Temporary Investigative Group recommended that 4,519 units be considered for proposed H-3 or H-4 hotel zoning. That is a possible zoning pathway, not an exemption a traveler should assume has already been approved. Confirm the status of the exact property rather than relying on a building-wide claim.

Legal vacation rentals continue operating in 2026, including units in hotel-zoned districts and other authorized accommodations. If you have returned to the same condo for years, ask the manager for the property’s current county authorization and state tax registration before booking. Do not infer legal status from an old stay or an active listing.

Hawaiʻi County’s Ordinance 25-50 created a countywide registration framework for hosted and unhosted transient vacation rentals. The County’s current code table lists September 1, 2026 as the effective date. On September 7, the County announced that its online TVR registration platform was live. The requirement covers rooms, homes, condos, and similar accommodations rented for fewer than 180 consecutive days.

The County says rentals with valid short-term-vacation-rental permits, nonconforming-use certificates, or bed-and-breakfast approvals before September 1 are deemed registered and will receive further instructions. New operators now register through the online portal. That means the useful traveler question is not simply, “Where is the new number?” Ask which current County registration or prior approval applies to the exact unit you are booking.

For a winter stay, ask the host or property manager to identify the property’s County registration, STVR permit, nonconforming-use certificate, or bed-and-breakfast approval. Save the answer with your booking confirmation. If the host cannot explain which authorization applies, do not treat the listing platform itself as proof. Oʻahu permits short-term rentals in eligible resort areas and through limited nonconforming-use certificates. The City and County of Honolulu’s short-term-rental FAQ says advertisements for stays under 30 days must display an STR registration or NUC number and the property’s tax map key, unless the accommodation qualifies for a listed exception.

Kauaʻi permits vacation rentals within its Visitor Destination Area and recognizes qualifying nonconforming rentals outside that area through TVR-NCU certificates. The County of Kauaʻi publishes its current approved-property list, which is the best place to verify a claim about a rental outside the visitor district.

Rules differ by island, so a permit type that is valid on one island tells you nothing about a listing on another.

A Hawaiʻi vacation rental should display state General Excise Tax and Transient Accommodations Tax registration numbers. Use Hawaiʻi Tax Online for state tax information, then verify the separate county authorization through the island-specific sources above.

On Oʻahu, look for an STR registration or NUC number plus a tax map key. On the Big Island, ask for the current County registration or the valid prior approval that the County treats as registered. On Maui, ask what zoning or authorization allows the transient use. On Kauaʻi, compare the property with the County’s approved TVR-NCU and homestay list when it is outside the Visitor Destination Area.

Red flags include listings that show no permit or tax information and hosts who dodge questions about legal status. A low price is not proof of a problem, but it should not persuade you to ignore missing authorization or restrictive cancellation terms.

The policy goal is to return apartment-zoned units to long-term residential use. Whether every affected condo becomes attainable housing will depend on its price, carrying costs, condition, and the future actions of owners and Maui County. Visitors should not treat either outcome as guaranteed.

For visitors, the practical impact is a booking process that requires due diligence. Confirm that the exact unit is authorized for the stay dates, understand the cancellation terms, and keep the registration evidence with the reservation.
